The Supreme Court on Wednesday directed the Central Government to provide data about criminal cases registered under the Muslim Women (Protection of Marriage Rights) Act, 2019 for the announcement of triple talaq. The court was hearing the petitions filed by Muslim organizations challenging the constitutionality of the 2019 Act. The parties will have to file written arguments from both sides. The Supreme Court ordered, investigate and give us data on the number of FIRs filed. The petitioners argued that the law has introduced the specific punitive law for a section of individuals on the basis of religious identity. This is the cause of serious public mischief, which if not controlled can cause polarization and disharmony in the society. He further argued that since the Supreme Court has already declared the practice of triple talaq unconstitutional in the Shaira Bano case, there is no purpose of the law.
It has been argued that the intention behind this law is not to end the triple talaq but to punish Muslim husbands. The court also commented that the petitioners were only challenging the criminalization of this practice and not defending this practice.
