Judicial activism should not be converted into judicial terrorism: Chief Justice Gawai

The Chief Justice of India (CJI) BR Gavai insisted on the remaining ‘judicial activism’ in the country, but also warned that it should not be converted into ‘judicial terrorism’.

Chief Justice Gawai said that the power of judicial review should be used with restraint. He said that it should be used only when a law violates the basic structure of the Constitution.

In response to the question of a law news portal, Justice Gawai said, “Judicial activism will remain. But judicial activism should not be converted into judicial terrorism. Therefore, many times you try to cross borders and try to enter an area where the judiciary should not enter. ”

The CJI described the Constitution as a ‘cool revolution carved by ink’ and a transformative power, which not only guarantees rights, but also actively uplift the oppressed people.

On Tuesday, the Chief Justice highlighted the positive impact of the Constitution on the marginalized communities and gave an example to clarify this to clarify this.

Justice Gawai is the second Dalit and first Buddhist judge to hold India’s highest judicial post. The Chief Justice said, “Many decades ago millions of citizens of India were called ‘untouchables’.
