A Varanasi court on Tuesday dismissed a petition seeking strict action against him to summon Lord Rama to call Lord Rama a mythological character during his speech at Brown University in the US in April this year.Advocate Harishankar Pandey, who filed the petition, said that his petition was dismissed by Additional Chief Judicial Magistrate Neeraj Kumar Tripathi, who considered it “non-stable”.The court said that according to the provisions of the Indian Civil Protection Code (BNSS) 2023, prior permission from the Central or State Government or District Magistrate is mandatory in such cases.

Advocate Harishankar Pandey, who filed a petition against Rahul Gandhi, said that Additional Chief Judicial Magistrate (ACJM) Neeraj Kumar Tripathi has dismissed the petition. The court considered the petition a “non-stable”, which dismissed the case.The court said that according to the provisions of the Indian Civil Protection Code (BNSS) 2023, prior permission from the Central or State Government or District Magistrate is mandatory in such cases.The lawyer said that he would now seek permission from the District Magistrate and file a petition again.
What was the matter?
The complaint was filed by advocate Harishankar Pandey on May 12, alleging that during his speech at Brown University, Rahul Gandhi described Lord Rama as a “mythological and fictional person”. Pandey urged the court to direct an FIR under the relevant sections of the law.
