A US court has said that the head of a federal monitoring agency, Hapton Daliner, should be retained and President Donald Trump’s attempt to remove him is illegal. American District Judge Amy Burman Jackson favored Heton Deliner, head of the Special Counsel Office in a legal battle over the President’s right to remove the head of the independent agency.
It is likely that the command of this agency may once again be handed over to the US Supreme Court. Deliner filed a case against Trump last month after the removal of himself. However, according to the law, the President can only remove special lawyers for disability, neglect of duty or misconduct in the office.
Deliner was appointed by Democratic President Joe Biden and the High House of the US Parliament was approved by Senate in 2024 for a five -year term. Jackson rejected the Trump administration’s claim that the protection from the removal of the special lawyer is unconstitutional.
The judge said that allowing the President to remove the special lawyer at his own will would adversely affect the important duties of the special lawyer. Jackson wrote in his judgment that special lawyers are expected to continue work and ensure fairness despite political changes.
The decision has come at a time when the Deliner Trump administration is challenging the abducted employees under the government under a large scale change in the government. On Tuesday, a federal board had banned the dismissal of several priest employees, as Deliner said their dismissal could be illegal.Dliner said in a statement on Saturday, “I am happy and I am thankful that the court has approved the importance and validity of security given by Parliament to my post.”
