In the Gyanvapi Mosque case of Varanasi, the Hindu side said before the local court that ASI has expertise in discovering archaeological things, hence excavation should be done under the central dome of the mosque and the place of Jyotirlinga should be surveyed. Hindu side’s advocate Madan Mohan Yadav said that Civil Judge (Senior Division) Jugal Shambhu, after hearing the arguments, has fixed October 19 as the next date of hearing of the case. Advocate Yadav said, the advocates of the Hindu side, in their argument before Judge Shambhu, said that the action of ASI survey has already been taken in the case of five women litigants. The Archaeological Survey of India (ASI) has expertise in excavation work.

He argued that Sarnath and Rajghat in Varanasi were excavated by ASI and even Mohenjodaro and Harappa were excavated by ASI. Yadav said, on the same basis, 4×4 feet excavation of Gyanvapi should also be done and the place of Jyotirlinga under the central dome of Gyanvapi should be surveyed. He said that the court has fixed October 19 for hearing in this case. According to him, it is expected that the Muslim side will present its arguments before the court in the next hearing. On October 8, the lawyers of the Muslim side had reportedly argued before the court that when the Hindu side had appealed to proceed with the hearing of the case in the High Court and the Supreme Court, then there was no point in arguing the case in the lower court. Not there.

He also said that when the ASI survey of Gyanvapi complex has been done once before, then there is no justification for conducting a second survey. The lawyers on the Muslim side had also said that digging a pit in the mosque premises for survey is not practical in any way and it could cause damage to the mosque. Earlier, the Hindu side had argued that the original location of the Jyotirlinga existed under the dome of the mosque located in the Gyanvapi complex. The Hindu side had also said that geological water was continuously flowing from Argha which collected in Gyanvapi Kund. This pilgrimage is also considered as Gyanodya pilgrimage. The Hindu side had also said that the Shivalinga recovered from Gyanodaya Tirtha should also be examined to find out whether it is a Shivalinga or a fountain. The Muslim side is calling it a fountain of the Mughal period.
