The story of one hour, 21 minutes and 46 seconds came from the words of the same person who shocked the country and the world. Atul Subhash, a 34-year-old engineer, is in the news all over the country after his dead body was found hanging from a fan inside a room in Bangalore. Atul’s name is not being discussed. Rather, what is being discussed is the death of a husband and the noise that arises after his death. Before committing suicide, Atul Subhash had accused his wife, his mother-in-law and Judge Rita Kaushik posted in Jaunpur Family Court of abetting his suicide and allegations of corruption. In the year 2021, an attempt at mediation between Atul and his wife Nikita Singhania failed. This year Nikita and her family tried to mediate with Atul’s family in Samastipur, Bihar. The effort is to resolve the ongoing dispute between Atul and Nikita. The husband and wife should agree to separate by mutual consent. There was a conversation between the two families. According to media reports, Nikita’s family had agreed to separation on a lump sum amount of Rs 22 lakh. According to the claims, this entire conversation took place at the house of Chartered Accountant Pankaj Jyoti of Samastipur. During the conversation, Atul kept talking to his father on the phone.

Before leaving, Atul made serious allegations against his wife’s family and the justice system. This was Atul’s ordeal. In his last 80-minute video, he was saying that ending his life was his last resort. If this happens, Nikita and his family will not be able to get anything. But it is still not clear what Nikita’s family thinks. In the case of the death of software engineer Atul Subhash in Bengaluru, a petition demanding appropriate amendment in the existing law of dowry harassment/domestic violence has been filed in the Supreme Court. In this petition, it has been demanded that a committee should be formed under the chairmanship of a retired judge of the Supreme Court, which should give suggestions for improving these laws. The petition has demanded that whatever gift/money is given during the marriage should be mentioned in the records during marriage registration.
There is a big tendency to get implicated in dowry cases.
The Supreme Court has again said that courts should be careful in dowry harassment cases so that misuse of the law can be prevented. Even those who are innocent can be saved from unnecessary troubles. The apex court noted that the tendency to implicate the husband’s family members has increased. The court made this comment while ordering quashing of the FIR. Justice B. A bench led by Justice V. Nagarathna said that inclusion of names of the husband’s family members in the matrimonial dispute without involving their cause should be stopped at the outset. Whenever a marital dispute begins, there is often a tendency to implicate the husband’s entire family. The allegations are general and there is no solid evidence to support them. This cannot become the basis of a criminal case. In such a situation, courts should be careful so that misuse of legal provisions can be prevented.

Will have to give the same life to the wife
Maintenance can be demanded under CrPC, Hindu Marriage Act, Hindu Adoption and Maintenance Act and Domestic Violence Act. Under the Hindu Marriage Act, there is a provision to give alimony in lump sum or on monthly basis at the time of divorce. There is no formula as to how alimony will be decided. It depends on the status of the parties. But the Supreme Court has again made it clear that the life style of the wife in her in-laws house will have to be maintained.
