The Delhi High Court on Friday dismissed a petition requesting clarification on its order to settle the appeal filed in the case of installing a statue of Maharani Laxmibai at Shahi Idgah Park in Sadar Bazar, Delhi.
A bench of Chief Justice DK Upadhyay and Justice Tushar Rao Gedela said the court orders should be understood in the context in which they were passed and their October 7, 2024 order does not require any explanation.
The bench told the lawyer of the royal Idgah management committee, “There is no need for any explanation in our order. You are asking us to explain your order. Follow the appropriate legal measures to challenge the notice (issued by DDA). ”
The committee sought an explanation on the order of the single judge of the High Court, which he said that his comments were temporary and were only aimed at resolving the disputed issue and it is not similar to transferring ownership of Waqf property to the Delhi Development Authority against the provisions of the Waqf Act.
The bench had settled the committee’s appeal against the order of the single judge who refused to ban the installation of the statue of freedom fighter.
It was reported that the statue has already been installed by the MCD and the installation of the statue has not violated the rights of those who pray at that place.
The committee’s application states that the DDA is demanding a fee from the appellant to organize the annual religious conference ‘Ijtema’ at Idgah Park. A judge also dismissed the petition of the committee seeking instructions to the corporation officials not to encroach the land of the royal Idgah. The petition claimed that Idgah is the property of Waqf.
