The court has stayed the order for further investigation until the next hearing. The next hearing date is 21 April. Delhi Police has also filed a petition against further investigation order. Last week, a Delhi court ordered an FIR to investigate Kapil Mishra’s alleged role in the 2020 riots in the national capital. Additional Chief Judicial Magistrate Vaibhav Chaurasia found a “prima facie” cognizable offense and said that Mishra’s presence at the scene could not be ruled out and required an inquiry against him and others in the case.

The judge had said that it is clear that Mishra was in the area at the time of the alleged crime … further investigation is needed. The court directed the Delhi Police to file the next hearing in the case by 16 April. The application was filed by Mohammad Ilyas, a resident of Yamuna Vihar, demanding an FIR to register an FIR against the then SHO Mishra of Dayalpur police station and five others – including BJP MLA Mohan Singh Bisht and former MLA Jagdish Pradhan and Satpal MPs.
