Allahabad High Court increased interim stay on demolition of Madina Mosque in Fatehpur district

The Allahabad High Court on Friday refused to demolish the structure till the next hearing in the demolition of the Madina Mosque in Fatehpur district.

Due to non -completion of the hearing in the case on Friday, Justice Manish Nigam extended the interim order till the next hearing and ordered the hearing in the case in the third week of July. This petition has been filed by Waqf Sunni Madina Mosque Committee Chairman Hyder Ali challenging the order passed against illegal construction on the land of Gram Sabha.

This order was passed under Section 67 (5) of Uttar Pradesh Revenue Code, 2006. The petitioner’s counsel SFA Naqvi argued that the action taken under Section 67 of the Uttar Pradesh Revenue Code, 2006 did not comply with the decision given in 2013 in the case of Rishipal and other vs. State Government.

He also argued that the entire process was concluded within 26 days and the petitioner was not given any opportunity to file evidence in favor of the case. Passing the interim order, the court said, “The petitioner’s counsel has argued that no conclusion has been filed on the objection of the petitioner while taking action under Section 67 and the order was passed only on the basis that the petitioner has encroached on the land of the Gram Sabha. The appeal filed by the petitioner was also rejected.
