Delhi Police filed its written arguments before the Rouse Avenue Court, protesting the petition demanding an FIR against Delhi minister Kapil Mishra. Delhi Police has said that Kapil Mishra is being implicated in the case, while he had no role in the 2020 north-eastern Delhi riots. The police told the court that the investigation had revealed the conspiracy to really false Mishra to falsely implicate and a plan was to be portrayed to lead him to lead the violence.
The case was heard by Additional Chief Judicial Magistrate Vaibhav Chaurasia in the Rouse Avenue Court. In August 2024, an application filed by Mohammad Ilyas, a resident of Yamuna Vihar, demanded an FIR against the then station house officer (SHO) Mishra of Dayalpur police station and three BJP leaders – Mustafabad MLA Mohan Singh Bisht, and five others including former MLA Jagdish Pradhan and Satpal MP.
Ilyas, who was represented by advocate Mahmud Pracha, alleged that on February 23, 2020, he saw Mishra and his colleagues blocking a road in Kardampuri and destroying the vehicles of road vendors. He further claimed that the then Deputy Commissioner of Police (North East) and other Delhi Police officers were standing next to Mishra, and warning the protesters to vacate the area or suffer the consequences. The complainant gave details of three different incidents in the next three days, during which he allegedly saw Dayalpur SHO sabotage in mosques in northeastern Delhi along with Pradhan, Bisht and Parliament.
