The lawyer appearing on behalf of the petitioner Vijay Kishore Goswami argued that it is arbitrary to provide special facilities to the VIP for visiting temples and a violation of the principles of equality under Article 14 of the Constitution. He said that standard operation process (SOP) should be created so that everyone gets equal opportunities.

The Supreme Court orally stated that no special behavior should be done with anyone in the case of entry into temples, but refused to take action on a petition seeking to abolish VIP philosophy facilities in temples. However, a bench of Justice Sanjeev Khanna and Justice SC Sharma said that the officials concerned are free to take any action to be considered appropriate. The court said that although our opinion may be that no special treatment should be given regarding entry into temples, we do not think it is a suitable case to exercise jurisdiction under Article 32. We clarify that dismissing the petition will not stop in any way. Prevent appropriate officials from taking action as per their requirement.

When he said that the lack of SOP is also causing unfortunate accidents like stampede, the bench said that the petitioner’s concern seems to be about the law and order and the petition should have been specific on it.

The lawyer said that religious tourism in the total tourism sector of the country is more than 50 percent, and said that now special philosophy facilities are followed in 12 Jyotirlingas and all Shaktipeeths. The petition argued that the temples charged with the devotees for close visit are discriminated against the devotees who do not have financial resources to pay the VIP entry fee.
