After being in jail for more than 15 days due to criticism from the Government of India on social media during the India-Pakistan struggle, when a student came out of jail on Tuesday night, he and her family members became emotional.
The Bombay High Court granted bail to the 19 -year -old engineering student, and made a sharp remarks against the Maharashtra government to “ruin her life” and see her as a staunch criminal. The court also reprimanded the college’s college – Singhgarh Academy of Engineering – as he had hurriedly issued a removal order against her without giving the student opportunity to clarify.
The High Court suspended the removal order and directed the officials of the Yerwada Central Jail to release the student on Tuesday itself. The student originally from Jammu and Kashmir was released from jail at around 9.30 pm on Tuesday night after completing all the formalities as per the order. The student’s lawyer Farhana Shah gave this information.
The girl’s family members were present outside the jail and wanted to stay away from the media. He only said that he trusts the constitution and the legal system of the country.
The controversy began on May 7 when a Bachelor of Engineering (Information Technology) student shared a post on Instagram with an account named Reformistan. However, when he realized his mistake, he deleted the post and also apologized.
Despite immediate deleting the post, the Kondhwa police of Pune registered an FIR against him on May 9 and arrested him. He was later sent to judicial custody in Yerwada Jail. The college also immediately expelled him.
The student approached the Bombay High Court, challenging her expulsion and demanding the cancellation of the FIR. On Tuesday, the High Court strongly condemned the government’s response and called it very shocking and rigid.
The court ordered him to be released immediately so that he could take his semester examinations. The court directed the Singhgarh Academy of Engineering to provide him a hall ticket and arrange for his examinations and arrange a separate class for his examinations.
The police has also been instructed to ensure adequate security when the student comes to college, so that her fears can be resolved. Kishore Patil, Principal of Engineering College, said that the institute has released the admit card to the student.
He said, the college has issued an admit card to the student on Wednesday. She will take the exam tomorrow. ” However, the principal refused to say whether any special class or arrangement has been made for the student during the examination.
Due to the arrest, she missed out on giving two papers and requested the High Court to consider it a special case, but the college said that the decision was to be taken to the university in Pune, after which the court allowed him to file an application in the university.
The court questioned the hasty approach of the college and said that her job should be improved by the student, not to punish her. The court said that he should not have been arrested earlier, especially when he immediately removed the post and apologized.
The college had said in the May 9 order that it had taken this decision due to the infamy of the institute, anti-national sentiments and risk for society. While warning the student to appear responsibly in future and avoid uploading such posts, the High Court had made strong comments on the government’s way of dealing with the situation.
