uttarakhand high court acquits man in 1993 dowry death case

The Uttarakhand High Court has acquitted a person in the 32 -year -old dowry murder case, who was convicted by the subordinate court. In the judgment pronounced on Friday, a single bench of High Court Justice Pankaj Purohit freed Ram Kumar Gupta from the allegations leveled against him under the Dowry Prohibition Act.

The bench gave the verdict by the lower court referring to serious anomalies and irregularities in his conviction. The bench said that the lower court convicted the accused on the basis of heard and heard things written on his behalf on the basis of photostat copies of the wife’s dowry murder and the alleged letters written by it and considered them a valid proof.

The judgment states that there is no legal validity of photocopy in the absence of original copy. Gupta, a resident of Chamoli district, was booked under the Dowry Prohibition Act after the death of his wife in 1993.

The Chamoli district court convicted Gupta in 2007 for the death of his wife in the dowry murder case. The court sentenced him to two and a half years. Gupta challenged the decision of the lower court in the High Court claiming that he had good relations with his wife and did not demand any dowry. His brother also confirmed this in his testimony.

Gupta informed the wife’s family about his accidental death. He died due to accidental scorch while cooking. Gupta said in his petition that the wife’s last rites were performed with the consent of his family. The woman’s family later accused Gupta of dowry harassment, although the investigating officer confirmed that the case was delayed by one and a half years.

The petitioner argued that the complaint of harassment from the FIR lodged late in the case seems suspicious. Apart from this, the woman had said in a pre -death statement before the Sub Divisional Magistrate (SDM) that she was scorched while cooking and her husband is not responsible for it. After the hearing, the High Court dismissed the Chamoli court verdict and acquitted Gupta from all the allegations under the Dowry Prohibition Act.
