The local court on Thursday dismissed the interim bail plea of Shahi Jama Masjid president Zafar Ali and on 2 April on his regular petition. Additional District Judge II Nirbhay Narayan Rai heard the interim bail plea and dismissed it, additional district government lawyer Hariom Prakash Saini. He said that during the hearing, Ali’s lawyer argued an interim bail, but the prosecution protested him and cited serious allegations such as gathering crowds, inciting violence, damaging public property and creating facts. Saini said that on the basis of arguments, the court refused to grant him interim bail and fixed the hearing on the regular bail plea on 2 April.

Ali was arrested on 23 March. He was questioned on November 24 in connection with the violence during the protests held on the court’s order of the Mughal mosque. On the same day, Ali’s bail plea was rejected by a Chandausi court and sent him to Moradabad Jail for two days judicial custody. A case was registered against Ali under several sections of the Indian Justice Code, in which 191 (2) and 191 (3) (riot), 190 (Every member of the illegal assembly for crime committed for general purpose), 221 (obstructing public servants in discharge of public work), 125 (Working of others’ life or personal security), 132 (Out of others), 132 (Outside), 132 (Following to stop the discharge of public servants) Use of force), 196 (promoting enmity between different groups on the basis of religion, caste, place of birth, residence, language etc.), 230 (giving false evidence with the intention of achieving conviction for the death penalty for a crime of death) and 231 (False evidence or coordination with the intention of acquiring 231 (to convict life imprisonment or imprisonment for life imprisonment or imprisonment.

A case has been registered against Ali under the provisions of the Public Property Damage Prevention Act. Ali denied the allegations and claimed that he has been implicated. Ali’s elder brother Tahir Ali alleged that the police sent his brother “deliberately” to jail before the judicial panel lodged his testimony. The Uttar Pradesh government formed a panel to investigate the violence during the protest over the survey in which four people were killed and many were injured.
